These Terms of Service ("Terms") govern your access to and use of the services ("Service") provided by the Company ("we", "our", or "us"). By using the Service, you agree to these Terms.


1. Nature of the Service

The Service provides a managed platform that enables clients ("Clients") to create, host, and operate their own websites, which may include subscription-based services, one-time payments, or other monetization models determined by the Client.

The Company acts solely as a technology provider and infrastructure operator.

The Company does NOT:

  • create content
  • upload content
  • act as a publisher or producer
  • control user-generated content

2. Client Responsibility

Clients are solely and fully responsible for:

  • All content published on their websites
  • Compliance with all applicable laws and regulations
  • Verifying age, identity, and consent of all individuals
  • Maintaining legally required records (including 2257 compliance where applicable)
  • Handling disputes with their end-users

The Company has no responsibility or liability for any content or activity on Client websites. The Client explicitly acknowledges that the Company does not verify, monitor, or control user-generated content and is not responsible for any actions taken by end-users of Client websites.


3. Prohibited Use

Clients may NOT use the Service for:

  • Any content involving minors (zero tolerance)
  • Non-consensual or abusive content
  • Copyright infringement
  • Illegal content under any jurisdiction
  • Any activity that may create risk for payment providers or infrastructure

The Company reserves the right to suspend or terminate access without notice.


4. Payments & Chargebacks

Payments may be processed through third-party providers, including but not limited to:

  • Epoch
  • SegPay
  • Cryptocurrency processors

The Company may act as a technical intermediary for payment processing. The Client acknowledges and agrees that:

  • The Company is not the merchant of record for the Client’s content or services
  • The Client is solely responsible for all transactions conducted on their website
  • The Client is fully responsible for chargebacks, refunds, disputes, and customer complaints
  • The Client’s business practices directly affect payment processing risk

The Company reserves the right, at its sole discretion, to:

  • Withhold or delay payouts
  • Require reserves or rolling reserves
  • Suspend accounts
  • Terminate services
  • Restrict access to funds

The Company is NOT liable for any financial losses related to chargebacks or payment disputes. The Company makes no guarantees regarding payment processing, including approval rates, acceptance by payment providers, or continued availability of payment services.


5. Hosting & Content Handling

Content may be stored on infrastructure operated by the Company. The Client acknowledges that the Company acts solely as a hosting and technical service provider. The Company does not actively monitor or review all content and assumes no responsibility for such content. The Company reserves the right to remove, restrict, or disable access to any content at any time, without notice, if deemed necessary for legal, compliance, or risk management purposes.


6. DMCA & Legal Complaints

The Company responds to legal and copyright complaints. Actions may include:

  • Immediate content removal
  • Account restriction or termination
  • Disclosure of relevant data when legally required

The Company may act upon complaints without requiring proof beyond what it considers sufficient in its sole discretion.


7. KYC & Compliance

The Company may require identity verification (KYC) at any time. Clients may be required to provide:

  • Government-issued ID
  • Address verification
  • Tax information

The Client agrees to provide accurate and complete information.

Failure to comply, or provision of false or misleading information, may result in immediate suspension, termination, and/or withholding of funds.


8. Service Availability

The Service is provided "as is" and "as available". No guarantees are made regarding:

  • uptime
  • availability
  • data preservation

9. Limitation of Liability

To the maximum extent permitted, the Company is not liable for:

  • Loss of revenue or profits
  • Content removal
  • Account suspension
  • Payment processor actions
  • Third-party failures

In no event shall the Company's total liability exceed the amount paid by the Client to the Company during the preceding 30 days.


10. Indemnification

Clients agree to indemnify and hold the Company harmless from any claims, damages, or legal actions arising from:

  • Client content
  • Client business activities
  • Violations of these Terms

11. Termination

The Company may suspend or terminate access at any time without notice if risk is detected. The Company reserves the right to take any action it deems necessary to protect its infrastructure, payment relationships, and legal standing.


12. Governing Framework

These Terms operate under international commercial standards. The Client acknowledges that they operate an independent business using the Service. Nothing in these Terms creates a partnership, joint venture, or agency relationship between the Client and the Company.
